DOJ Ends LGBTQIA+ Safety Standards In Prisons

This decision will get people raped and murdered! DOJ is in the process of revising the federal standards related to the 2003 Prison Rape Elimination Act (PREA) in order to align with Trump's executive order on "gender ideology extremism" that only recognizes two sexes: male and female. A 2015 survey from criminal justice group Black and Pink found LGBTQIA+ prisoners were over six times as likely to be sexually assaulted as the general prison population. They will also be housing transgender people in the wrong prisons based on their sex at birth.

GOP's Obsession Attacking LGBTQIA+ People - Across 12 must-pass federal funding bills, MAGA members of Congress have proposed more than 50 anti-LGBTQIA+ provisions. We've seen similar laws proposed in each of the states. They've attacked our health care, drag shows, pride flags, DEI efforts, non-discrimination rights, and everything else they can think of. Trump has used recission powers to strip away already-approved funding from housing, HIV prevention, health care, and so much more. They have stopped all foreign aid that helps protect our communities in developing nations. Trump has used executive orders to target us, and refuses to acknowledge Pride or World AIDS Day. Their unrelentless attacks against the transgender community has been dangerous and heart-breaking to watch.

Human Rights Campaign has just released this updated 16-page report called "Power of the Purse: Anti-LGBTQ+ Extremism in the Congressional Appropriations Process" that examines this problem further.

Texas Transgender "Bathroom Bill" Goes Into Effect

On Thursday, the Texas Women’s Privacy Act goes into effect which is going to make going to the bathroom more dangerous for women and especially transgender women. There aren't many guidelines on enforcement, so any woman that looks "butch" is likely to get harassed. The transgender population will be forced to use the wrong bathroom, which will increase the violence against them. Public and private spaces have different rules, which will add to the inconsistencies and confusion about the law.

I'm so sorry that Texas passed this discriminatory law, and I'm afraid my trans friends are going to lose even more rights when the Supreme Court issues their opinions in June. Teachers Are Outing And Deadnaming Transgender Students Because of "Don't Say Gay" Laws

In June, Texas passed a "Bill of Parental Rights” which has been dangerous for LGBTQIA+ students. It shut down all of their GSA clubs so they have no support, and the teachers are forcing the students to use their deadname and gender at birth. This will increase youth suicide, runaways, bullying, and violence against them. Schools need to be a safe place for everybody, and these hateful laws destroy that. Florida and lots of other red states have similar laws. There are also numerous book bans across the country that are censoring all books that relate to LGBTQIA+ or gender identity. We have to stop the spread of these harmful laws, and repeal those that already exist. 🏳️‍🌈🏳️‍⚧️

SCOTUS Will Not Hear Kim Davis Case to Overturn Marriage Equality

The Supreme Court has not granted certiorari to hear the Kim Davis case to overturn same-sex marriage. We can breathe a quick sigh of relief, but the fight is far from over. 🏳️‍🌈
In decisions to be released by June, I'm expecting them to overturn the bans on conversion "therapy" and to further restrict the rights of our transgender community. 😭

Foster Parents and LGBTQIA+ Safety

The notorious Alliance Defending Freedom (ADF) is taking cases where "Christian" foster parents claim the religious freedom not to sign a nondiscrimination agreement that affirms the gender identity and sexual orientation of the children. The agreement is required so that LGBTQIA+ children are placed in safe homes.

In Massachusetts, they require the foster parents to respect each child’s chosen name, their pronouns, and their gender expression, prohibiting any attempts to change a youth’s identity. This is especially important to prevent "Christians" who want to perform harmful "conversion therapy" on kids.

The Supreme Court has recently heard a case where "Christians" claim religious freedom violations because of the many state bans on "conversion therapy." We should receive a decision on that case by June, but we also need to monitor these harmful ADF cases that are working their way through the courts.🏳️‍🌈🏳️‍⚧️

SCOTUS Docket for Kim Davis Marriage Equality Case

It's no surprise that Ol' Roy Moore's Foundation for Moral Law is trying to file an amicus curiae (friend of the court) brief. I also see National Organization for Marriage, et al. has filed one. SCOTUS voted today whether to grant certiorari to hear the case, and we should hopefully see their decision on Monday's Order List. It is SCOTUS case #25-125.

Anti-Trans/Anti-Nonbinary Passport Policy

Yesterday, SCOTUS used the shadow docket to overturn two lower courts and implement a discriminatory and dangerous passport policy that says they must display the gender at birth. The Supreme Court just reversed a lower court and says passports must reflect the person's biological sex at birth. Not allowing an X is discriminatory and dangerous for transgender people. We're expecting rulings by June that may make "conversion therapy" legal based on a ridiculous religious freedom argument. Tomorrow, SCOTUS is voting whether to take up a case that would ban same-sex marriages. It's going to be a rough time for the LGBTQIA+ community. 😭🏳️‍🌈

Drag Show Ban in Texas

The 5th Circuit Court of Appeals just overturned the lower court ruling on Senate Bill 12. They claim that plaintiffs didn't sufficiently prove their First Amendment claims and so the court remanded the case to the trial court for further inquiry. The 18 page opinion was written by three judges, and there's a link to it in this article. They wrote “we have genuine doubt… that pulsing prosthetic breasts in front of people, putting prosthetic breasts in people’s faces, and being spanked by audience members are actually constitutionally protected — especially in the presence of minors.” #DragIsNotACrime

Same-Sex Marriage Before SCOTUS on Friday

At the Supreme Court's November 7th private conference they will vote whether to take up the Kim Davis lawsuit to dismantle same-sex marriages. It takes four of the justices to vote to grant certiorari to hear the case, and Roberts, Alito, and Thomas are vocal opponents of marriage equality, so only one more vote would be needed. If they do choose to hear the case, my guess is that they will follow the same pattern as they did reversing Roe v. Wade. They will give the right back to the states. Because 32 states still have laws that prohibit same-sex marriage, there would would be only 18 states, five territories, and Washington, D.C. where same-sex marriage would be legal. Trump Pushes an End to Medical Care for Transgender Youth Nationally

Texas Same-Sex Marriages

Texas Supreme Court has revised the Texas Code of Judicial Conduct to clarify that judges who refuse to perform a wedding ceremony "on a sincerely held religious belief" do not violate the state's rules on judicial impartiality. Judges who decline to perform gay weddings won't face any sanctions. On November 7th, SCOTUS is going to take a vote on whether to hear the Kim Davis case which is asking them to reverse the Obergefell decision and end gay marriages.

Good evening Mayor Dollar and City Council Members,
My name is Gary Wright, and I’m a resident of Marshall County. I was one of the Alabama marriage equality plaintiffs, and for over two decades I’ve been working on issues that affect the LGBTQ community in our state and beyond. So I’d like to make a brief statement in regards to the shirt that Councilman Randy Whitaker recently posted to social media.
Through his wife’s Facebook page, Councilman Whitaker says he “has friends and family members who are gay” which is not surprising because despite what his novelty t-shirt says, LGBTQ stands for Lesbian, Gay, Bisexual, Transgender, and Queer and we represent over 10% of the population.
Because of the hatred that has been spewed from public podiums over the past few years, hate crimes are up across-the-board. What you do and say reverberate throughout the community. Not just in fostering hatred, but often resulting in self-harm by our most vulnerable communities. In young people age 10-24, suicide is the second leading cause of death. LGB youth contemplate suicide three times the rate of heterosexual youth, and are five times as likely to attempt it. 40% of transgender adults have made a suicide attempt. Each episode of LGBTQ victimization, such as physical or verbal harassment or abuse increases the likelihood of self-harm by 2-1/2 times.

While the social media posts and words spoken by our leaders are important, I’m much more concerned about what is posted in their hearts and the harmful actions they take. So I urge each of you to examine your heart, and if you’re unable or unwilling to treat everyone with the dignity and equality that they deserve, it’s time for you to resign from public office.
