Even though judges have been ordering the release of detainees on bond, ICE invokes a 9/11-era "automatic stay" regulation to keep them in detention. That automatic stay doesn't require approval from a judge or the Board of Immigration Appeals. In the past five years, the regulation was used only three times. Between July 1st and September 16th, ICE has used it 877 times. They are abusing it to deny due process!
