Chicago residents have come up with a simple solution to alerting neighbors about ICE raids: they are assembling whistles and passing them out to the community. We need to do this in all of the towns around America where ICE has a presence.

If you see ICE, give the whistle three short bursts.
If ICE is being aggressive or attempting to detain someone, give the whistle three long bursts.
Repeat until a crowd shows up.
Record everything that ICE does for evidence, but don't get too close or interfere.

You Can't Refuse Biometric Collection by ICE

According to a redacted ICE document (a link is in the article) "ICE does not provide the opportunity for individuals to decline or consent to the collection and use of biometric data/photograph collection." This means everyone must allow them to use facial recognition and fingerprints. Even if you're a citizen, the data is retained for 15 years. If their app says you're not a citizen, they won't even look at any supporting documentation you may have (like birth certificate or identification). This violates the 4th Amendment, but we have a fascist authoritarian government now and are living in a surveillance dystopia.

Cops vs. Federal Agents

In Colorado, the Durango Police Department received a report that one of the children in ICE custody may have been in distress and experiencing child abuse. Officers tried to conduct a welfare check and bring food, but the federal agents denied them entry into the facility. The feds also haven't allowed any members of Congress to visit any ICE facility as part of their oversight duties, using the government shutdown as an excuse. I can only imagine the horrors that they are hiding.

Chris Geidner has an excellent "Law Dork" blog on what just happened in the Supreme Court, the effort of DHS to protect Gregory Bovino, and about the indictment of six protesters at the Broadview ICE facility, including congressional candidate Kat Abughazaleh. The SCOTUS order should mean the National Guard is blocked from being deployed for at least another month while they decide the issue. National Guard in Portland Violated Court Order

Hours after US District Judge Karin Immergut issued a temporary restraining order regarding deployment of troops, they sent an "Advanced MP Squad" to help ICE. They opened fire on local police officers with pepper balls, and the judge is not happy. She is considering whether to hold them in contempt. Texas Supreme Court has revised the Texas Code of Judicial Conduct to clarify that judges who refuse to perform a wedding ceremony "on a sincerely held religious belief" do not violate the state's rules on judicial impartiality. Judges who decline to perform gay weddings won't face any sanctions. On November 7th, SCOTUS is going to take a vote on whether to hear the Kim Davis case which is asking them to reverse the Obergefell decision and end gay marriages.

Judge Ellis Orders Daily Meetings with Gregory Bovino

The border patrol chief must produce all use-of-force reports from agents involved in Operation Midway Blitz since September 2nd. Trump Wants More Violence Against Immigrants

In his efforts to start a civil war that justifies his use of the Insurrection Act, this morning he told troops in Japan that "more than National Guard was needed" for his deportation efforts.

Over the weekend, Trump and Noem wanted the leaders of ICE in Denver, Los Angeles, Philadelphia, Phoenix, and San Diego to be fired but after pushback they moved them all to headquarters and plans to replace them with leaders from border patrol. They have plans to focus on 25 cities as they fall far short of their goal of deporting 3,000 a day. They claim to be only arresting the "worst of the worst" but the data shows the majority of those arrested do not have criminal backgrounds. #AbolishICE

Tear Gas Use - Request to Modify TRO

In filing (docket #142) of CHC et al. v. Noem et al. they are asking the court to modify the TRO to prohibit the use of any tear gas until their motion on a preliminary injunction is heard. They say: "Plaintiffs suspect Defendants are inciting violence in peaceful residential neighborhoods to transform Chicago into the very 'war zone' that Defendants use to justify the deployment of more federal force. Defendants are engineering their own pretext for their presence and behavior in Chicago." They are gerrymandering the voting districts to retain power, and the judicial branch is burning the US Constitution amendment by amendment. The GOP says all of the remarks and merchandise are jokes and just “trolling”, but Trump has no plans of leaving office in 2028. It's time we start talking about what comes next in our country as fascists take away our rights one-by-one. In this article, the author ponders William Appleman Williams' vision for a continental confederation of regional commonwealths. Now that centralized power has taken hold, that next logical step may by nearly impossible to achieve.
