	<title><![CDATA[FBI And DHS Intimidating Protesters (Again)]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;">I've got a copy of an <strong>indictment</strong> that we all need to talk about! <strong>"Cop City"</strong> is a $118 million 85-acre police training facility built in <strong>Atlanta</strong>. They bulldozed a forest to create it in the middle of a <strong>Black community</strong>. <strong>Cop City</strong> wasn't wanted and it wasn't needed, so there were large groups of <strong>protesters</strong> who did everything they could to stop it because the government didn't care about their petitions or concerns. <strong>Police shot dead</strong> a peaceful protester while in his tent, and in 2023 Georgia filed <strong>RICO charges</strong> against <strong>61 activists</strong> and even said the <strong>bail funds</strong> were part of a <strong>racketeering</strong> operation. <strong>Georgia Attorney General Chris Carr</strong> called the protestors "</span><i><span style="white-space:pre-wrap;">domestic terrorists and violent criminals.</span></i><span style="white-space:pre-wrap;">" All of those ridiculous <strong>RICO charges</strong> eventually got dismissed.</span><br /><br /><span style="white-space:pre-wrap;"><strong>Samuel Tunick</strong> is an <strong>Atlanta</strong> musician and a <strong>Cop City activist</strong>. He recently visited a foreign country, and before he came back to the <strong>USA</strong> he wiped clean his Pixel cell phone. When he got to the airport in January to re-enter the <strong>US</strong>, <strong>CBP agents</strong> detained him and tried to force him to give them full access to his phone. They couldn't find what they were looking for, so he was released.</span><br /><br /><span style="white-space:pre-wrap;">On December 2nd, <strong>Tunick</strong> was pulled over in <strong>Atlanta</strong> where he was asked to step out of his car because of an issue with his taillight. He was at that point arrested by <strong>DHS</strong> and <strong>FBI</strong>. After his first night in jail, he learned during his court appearance that they had obtained an <strong>indictment</strong> from a federal grand jury. He was charged with one count of <strong>destruction of evidence</strong> because he had wiped his phone.</span><br /><br /><span style="white-space:pre-wrap;">This is a baseless case that must not stand! The government is still clearly trying to intimidate <strong>protesters</strong> through these ridiculous bogus prosecutions. Many people carry "burner" phones when they cross international borders because of the repressive laws in other countries. It seems now that the <strong>USA</strong> has become one of those repressive countries.</span><br /><br /><span style="white-space:pre-wrap;">The Indictment reads: </span><i><span style="white-space:pre-wrap;">"On or about January 24, 2025, in the Northern District of Georgia, the defendant, SAMUEL TUNICK, before and during the search for and seizure of property by Customs and Border Patrol Tactical Terrorism Response Team Supervisory Officer L.C., a person authorized to make such search and seizure, did knowingly destroy, damage, waste, dispose of, and otherwise take any action to delete the digital contents of a Google Pixel cellular phone, for the purpose of preventing and impairing the Government's lawful authority to take said property into its custody and control, in violation of Title 18, Untied States Code, Section 2232(a)."</span></i><br /><br /><span style="white-space:pre-wrap;">I'll be following this case closely as it progresses through the court system and I'll post updates as I get them. 	<title><![CDATA[ICE&#039;s Biggest Fear Is Transparency]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;">They aren't rounding up "the worst of the worst" they are going after the easiest, most vulnerable targets, and they're bypassing the law to do it. <strong>Trump</strong>'s goal was to deport 5,000 per day and thank god they are nowhere near reaching that goal. The arrest records show that the overwhelming majority of those being detained are not criminals. Those claimed to have "criminal records" mostly have minor things like traffic violations. Even if you paint those people as "criminals" they are far from being gang leaders or "the worst of the worst."</span><br /><br /><span style="white-space:pre-wrap;">What they have succeeded in doing is terrorizing our communities by carrying out raids with violent heavily-armed masked Gestapo thugs with no police training. When <strong>SCOTUS</strong> allowed <strong>racial profiling</strong> through <strong>"Kavanaugh Stops"</strong> that's exactly the method they used. They're trying to detain as many people as possible in order to reach their mission quotas, the laws be damned. They don't want the public to know what the real arrest numbers and criminal statistics are because it points to their abject mission failure despite all of their bluster and propaganda.</span><br /><br /><span style="white-space:pre-wrap;">Our greatest weapon against these domestic terrorists is to use our <strong>whistles</strong> and <strong>record</strong> everything that they do. We've been winning all of these legal cases mostly because of the videos that prove how <strong>they lie in court</strong>. We have to organize <strong>rapid-response groups</strong> in every community as they spread their efforts across the nation.</span><br /><br /><span style="white-space:pre-wrap;">In reporting out of <strong>Louisiana</strong>, it shows how the local and state police are helping them monitor social media through the local <strong>DHS Fusion Center</strong>. When <strong>DHS</strong>, the feds, and police got hacked during <strong>BlueLeaks</strong> we learned exactly how these <strong>fusion centers</strong> really work. Very few press outlets would cover the <strong>BlueLeaks</strong> revelations because of their relationship with police, but in places where the truly independent media covered it the <strong>fusion center</strong> got quickly shut down. 	<description><![CDATA[<p><span style="white-space:pre-wrap;">In April 2019, <strong>DOJ</strong> issued the results of their investigation into the conditions inside <strong>Alabama prisons</strong>. Sadly, nothing has been done. <strong>Governor Kay Ivey</strong> says </span><i><span style="white-space:pre-wrap;">"The Alabama Solution"</span></i><span style="white-space:pre-wrap;"> is to build more mega-prisons, so she took funds from education and COVID relief to build new billion dollar prisons. That fixes nothing!</span><br /><br /><span style="white-space:pre-wrap;">Election time is coming up, and we have a chance for new leaders to take the helm. As citizens, we have to get organized and demand a change. But in the interim, we need the <strong>DOJ</strong> to actually follow through on their investigation. 	<title><![CDATA[Broadview ICE Lawsuit Is Granted Class Action Status]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;"><strong>Federal District Judge Robert W. Gettleman</strong> has just certified the lawsuit against the <strong>Chicago ICE</strong> facility as a <strong>class action</strong> lawsuit. The class shall be:</span><i><span style="white-space:pre-wrap;"> "All immigration detainees who are detained and those who will be detained in the future at the Broadview ICE facility at 1930 Beach Street, Broadview, Illinois."</span></i><br /><br /><span style="white-space:pre-wrap;">There are "deplorable" conditions at the detention center:</span><br /><span style="white-space:pre-wrap;">1. Lack of adequate food;</span><br /><span style="white-space:pre-wrap;">2. Lack of sufficient clean water;</span><br /><span style="white-space:pre-wrap;">3. Lack of personal hygiene products;</span><br /><span style="white-space:pre-wrap;">4. Extremely overcrowded holding cells;</span><br /><span style="white-space:pre-wrap;">5. No access to sufficient bedding or space to sleep;</span><br /><span style="white-space:pre-wrap;">6. Dirty holding cells that are rarely or never cleaned;</span><br /><span style="white-space:pre-wrap;">7. Insufficient and dirty toilet facilities;</span><br /><span style="white-space:pre-wrap;">8. Lack of access to medication, including those that detainees arrived with on their person or that were provided by family members;</span><br /><span style="white-space:pre-wrap;">9. No access to showers or other bathing facilities; and</span><br /><span style="white-space:pre-wrap;">10. Lack of access to adequate clothing.</span><br /><br /><span style="white-space:pre-wrap;">Through their abuse and deprivation of rights, <strong>DHS</strong> is forcing detainees to sign self-deportation papers <strong>without legal counsel</strong> and without it being in their language, so they have no clue what they are signing.</span><br /><br /><span style="white-space:pre-wrap;">The judge made a personal visit to the facility last week, and allowed <strong>attorneys</strong> to hand out their cards to the <strong>detainees</strong> that are understandably fearful of talking. 	<title><![CDATA[Trump&#039;s DoJ Using &quot;Antifa&quot; Label for Enhanced Terrorism Charges]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;">Just as the <strong>DoJ</strong> abuses the <strong>Espionage Act</strong> to prosecute <strong>whistleblowers</strong>, they are now labeling people as <strong>"antifa operatives"</strong> in order to file enhanced <strong>terrorism charges</strong> against them.</span><br /><br /><span style="white-space:pre-wrap;"><strong>"Antifa"</strong> is just short for <strong>anti-fascist</strong>, and I'd like to think the majority of people in the world are <strong>anti-fascists</strong>. We already fought a world war over <strong>fascism</strong>, and the good guys won. <strong>Antifa</strong> in the US is not an organization and has no leaders. The only people in any danger from <strong>antifa</strong> are <strong>fascists</strong>, which is why <strong>Trump </strong>and some other <strong>authoritarian </strong>world leaders are paranoid about them. <strong>Trump</strong> also designated several foreign groups as <strong>"antifa networks"</strong> because they speak out against him.</span><br /><br /><span style="white-space:pre-wrap;">They are claiming to have caught a "<strong>North Texas Antifa Cell"</strong> after the <strong>July 4th attack</strong> on the <strong>ICE</strong> detention facility in<strong> Alvarado, TX</strong>. Some of the people arrested have been charged with </span><i><span style="white-space:pre-wrap;">"providing material support to terrorists"</span></i><span style="white-space:pre-wrap;"> and other federal charges that will greatly increase the penalty if convicted.</span><br /><br /><span style="white-space:pre-wrap;">A <strong>federal grand jury</strong> has <strong>indicted </strong>all of these people, but we don't know what the prosecutor told them and what choices of charges they were given. This is happening in deep red <strong>Texas</strong>, so we'll have to watch how the court case plays out. 	<title><![CDATA[Trump Makes An Example Out Of Representative LaMonica McIver]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;">There are federal charges against <strong>Rep. McIver</strong> for trying to do her job of <strong>congressional oversight</strong> of <strong>Delaney Hall Federal Immigration Facility</strong> on May 9th in <strong>Newark, NJ</strong>. She is a sitting <strong>Congresswoman</strong> representing <strong>New Jersey’s 10th Congressional District</strong>, and <strong>DHS</strong> claims she </span><i><span style="white-space:pre-wrap;">"did forcibly assault, resist, oppose, impede, intimidate, and interfere with a"</span></i><span style="white-space:pre-wrap;"> federal agent. These charges are just an intimidation tactic to dissuade other members of <strong>Congress</strong> from conducting their oversight duties of <strong>ICE detention centers</strong>.</span><br /><br /><span style="white-space:pre-wrap;"><strong>Rep. McIver </strong>and two other members of <strong>Congress </strong>tried to inspect the<strong> Delaney Hall facility</strong>. There was a protest in the front of the facility, so they allegedly followed a vehicle into a secure area, but then the <strong>mayor</strong> showed up and was denied access. The complaint alleges </span><i><span style="white-space:pre-wrap;">"the Mayor returned with members of his security detail and was able to enter inside the gate because the guard was under the impression that the Mayor was part of the Congressional delegation."</span></i><span style="white-space:pre-wrap;"> When they tried to arrest the mayor, <strong>Rep. McIver</strong> then allegedly made </span><i><span style="white-space:pre-wrap;">"multiple attempts to forcibly assault, resist, oppose, impede, intimidate, and interfere with the agents attempting to take the Mayor into custody."</span></i><span style="white-space:pre-wrap;"> They say the members of <strong>Congress </strong>tried to act as human shields to prevent the mayor from being arrested, and they allege <strong>Rep. McIver</strong> assaulted them. They provided still shot photos from <strong>surveillance cameras</strong> and <strong>BWC</strong> (Body Worn Cameras), but I haven't seen any video of the incident which probably tells a more accurate story. The photos are part of the original Complaint.</span><br /><br /><span style="white-space:pre-wrap;"><strong>Rep. McIver</strong> tried to have the case dismissed and even claimed <strong>legislative immunity</strong>, but <strong>Federal District Judge Jamel K. 	<title><![CDATA[Broadview ICE Class Action Lawsuit Update]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;">Yesterday, <strong>Magistrate Judge Laura McNally </strong>along with the attorneys for the plaintiffs took a tour of the <strong>ICE</strong> facility outside of <strong>Chicago</strong>. Seventeen minutes before the scheduled visit, the govt asked to accompany them on the tour. That request was denied as moot because of such little notice given to the court. I'm waiting for the results of that inspection to be filed on the court docket.</span><br /><br /><span style="white-space:pre-wrap;"><strong>ICE</strong> is claiming that the facility surveillance video between October 19, 2025 and October 31, 2025 that the plaintiffs requested has been </span><i><span style="white-space:pre-wrap;">"irretrievably destroyed"</span></i><span style="white-space:pre-wrap;"> and so they can't produce that evidence in accordance with discovery. That sounds like a cover-up effort to hide the evidence!</span><br /><br /><span style="white-space:pre-wrap;">The lawsuit is based on violations of the <strong>First Amendment, Fifth Amendment, Due Process, ICE policies,</strong> and the <strong>Administrative Procedure Act (APA)</strong>. They are complaining about the inhumane living conditions, lack of access to legal counsel, denial to medical care, lack of food and water, and other basic human rights violations.</span><br /><br /><span style="white-space:pre-wrap;"><strong>ICE</strong> intentionally makes things difficult for them to pressure them into signing <strong>self-deportation</strong> forms that they don't understand. That is despite a key rule that says, </span><i><span style="white-space:pre-wrap;">"The use of threats, coercion, or physical abuse by the designated immigration officer to induce a suspect to waive his or her rights or to make a statement is prohibited."</span></i><br /><br /><span style="white-space:pre-wrap;">The lawsuit says that when detainees make requests for basic essentials, <strong>ICE</strong> officers respond with </span><i><span style="white-space:pre-wrap;">"threats, abuse, or contempt."</span></i><span style="white-space:pre-wrap;"> They say they were </span><i><span style="white-space:pre-wrap;">"being belittled or ignored by officers when they asked for food and water." "When people asked for necessities, officers would insult detainees or make light of their suffering."</span></i><span style="white-space:pre-wrap;"> One detainee says, </span><i><span style="white-space:pre-wrap;">"She saw a man who was very ill and appeared to be having a heart attack. The officers at Broadview laughed at him and made light of his medical emergency."</span></i><br /><br /><span style="white-space:pre-wrap;">In the latest Joint Status Report, they have agreed to hold a hearing on the <strong>preliminary injunction</strong> on December 17th. 	<description><![CDATA[<p><a href="https://cleverpeople.com/blog/view/148164/alabama-man-deported-by-ice-despite-court-order"><span style="white-space:pre-wrap;">I previously wrote</span></a><span style="white-space:pre-wrap;"> about Alabama's <strong>Chanthila "Shawn" Souvannarath</strong> who had been detained and held in Louisiana's horrific <strong>Angola </strong>prison. He has been in the US and a <strong>lawful permanent resident</strong> since an infant, and his father had <strong>citizenship</strong>, so <strong>Federal District Judge Shelly Dick</strong> issued a <strong>Temporary Restraining Order (TRO)</strong> to prevent his removal until he was able to litigate his claim of citizenship. The judge wrote, </span><i><span style="white-space:pre-wrap;">"Though the Court does not tend to issue orders before all parties have had an opportunity to be heard, Petitioner’s substantial claim of U.S. citizenship and the irreparable harm that would be caused by immediate deportation warrant temporary intervention in this case."</span></i><span style="white-space:pre-wrap;"> Despite the <strong>TRO</strong>, <strong>ICE </strong>has deported him to <strong>Laos </strong>and claims they weren't served with the order until after he had been deported.</span><br /><br /><span style="white-space:pre-wrap;">Folks, the government gets electronic court docket notices just like I do, so there is no excuse for not knowing about the court orders. <strong>DHS/ICE</strong> is just clearly ignoring the <strong>US Constitution</strong>, as well as the orders by multiple federal judges. This does not bode well for the future our nation, as a lawless heavily-armed masked police force is terrorizing our communities. Get organized and protect each other!</span></p>]]></description>

	<description><![CDATA[<p>An October 17th <strong>FBI Bulletin</strong> was obtained by <a href="https://propertyofthepeople.org/">Property of the People</a> that revealed five instances where criminals impersonated <strong>ICE</strong> agents in order to commit crimes. The bulletin states that all law enforcement officers should <i>“adequality identify themselves during operations and cooperate with individuals who request further verification."</i></p><blockquote><p>“Due to the recent increase in ICE enforcement actions across the country, criminal actors are using ICE’s enhanced public profile and media coverage to their advantage to target vulnerable communities and commit criminal activity. This not only effects the victims and communities but also has broader negative consequences on law enforcement agencies.”</p><p>“These criminal impersonations make it difficult for the community to distinguish between legitimate officers conducting lawful law enforcement action and imposters engaging in criminal activity, which damages trust between the local community and law enforcement officers.”</p></blockquote><p><span style="white-space:pre-wrap;">I don't see the FBI bulletin posted on their website yet, but </span><i><span style="white-space:pre-wrap;"><strong>Property of the People</strong></span></i><span style="white-space:pre-wrap;"> has lots of other good documents of interest that they've obtained through <strong>FOIA</strong>.</span></p>]]></description>

	<title><![CDATA[NDAA Section 1122 Program Enables Police Militarization]]></title>
	<description><![CDATA[<p><span style="white-space:pre-wrap;"><strong>Section 1122</strong> of the <strong>National Defense Authorization Act (NDAA)</strong> for Fiscal Year 1994 established the authority for state and local governments to buy law enforcement equipment through federal channels, as long as the equipment is used for counter-drug activities. The <strong>Duncan Hunter National Defense Authorization Act</strong> for Fiscal Year 2009 amended <strong>10 U.S.C. 381</strong> to expand the procurement authority under <strong>Section 1122</strong> to include equipment for homeland security and emergency response activities. <strong>Biden </strong>had placed restrictions on the program, but <strong>Trump </strong>has since removed them and police are being militarized at an alarming rate with military equipment that they're not trained to use properly.</span><br /><br /><span style="white-space:pre-wrap;">Another problem with the <strong>1122 program</strong> is lack of <strong>transparency</strong>. I've written in years past about the woefully incomplete and inadequate public disclosures about what military equipment was sold and where it went. If you've ever wondered how the local and state <strong>police </strong>are obtaining tanks, body armor, weapons, and heavy equipment - then <strong>Section 1122</strong> is to blame!</span></p>]]></description>

	<description><![CDATA[<p><span style="white-space:pre-wrap;"><strong>DHS</strong> had time to make <strong>propaganda videos</strong> from bodycams and drone footage, but they've turned over no video evidence to the plaintiffs. After a <strong>Motion to Compel</strong> was filed to force <strong>DHS </strong>to turn over their video evidence as part of their rolling discovery, <strong>DHS </strong>appealed to the <strong>7th Circuit</strong> who just granted a stay regarding the daily check-in's by <strong>Gregory Bovino</strong>. They've requested a <strong>Writ of Mandamus</strong> and an <strong>administrative stay</strong>. The <strong>7th Circuit </strong>responded: </span><i><span style="white-space:pre-wrap;">"IT IS ORDERED that the government’s request for an administrative stay is GRANTED. 	<description><![CDATA[<p><span style="white-space:pre-wrap;">Many have been following the case of <strong>Kilmar Abrego Garcia</strong>, but this abuse is happening to hundreds, if not thousands, of immigrants.</span><br /><br /><span style="white-space:pre-wrap;">A 44 year old Alabama father <strong>Chanthila "Shawn" Souvannarath</strong> had been a <strong>lawful permanent resident</strong> since his first birthday. During his annual check-in with immigration, they arrested him in front of his two children, and then he was locked up in an immigration detention facility at <strong>Louisiana's </strong>notorious maximum-security <strong>Angola </strong>prison. All of their reports to the court will be under seal. Here's the complete order:</span><br /><br /><span style="white-space:pre-wrap;">MINUTE entry before the <strong>Honorable Sara L. Ellis</strong>: Court hearing held. The Court enters and continues Plaintiffs' motion to modify the TRO 142 to the date of the preliminary injunction hearing on 11/5/2025. The Court orders Defendants to have all <strong>Federal Agents</strong> operating in </span><i><span style="white-space:pre-wrap;">Operation Midway Blitz</span></i><span style="white-space:pre-wrap;"> to place an identifier conspicuously on their uniform where one can easily view it and the Agent's equipment does not obscure it. <strong>Custom and Border Protection</strong> will strive to ensure that all <strong>CBP </strong>agents working in </span><i><span style="white-space:pre-wrap;">Operation Midway Blitz</span></i><span style="white-space:pre-wrap;"> have body-worn cameras. 	<description><![CDATA[<p><span style="white-space:pre-wrap;">Another <strong>notice of TRO violations</strong> has been filed in federal court. At 10AM tomorrow (Tuesday) there is a hearing where border patrol chief <strong>Gregory Bovino</strong> must appear in front of <strong>Judge Sara Ellis</strong>. They have violated her <strong>temporary restraining order</strong> in multiple ways and on multiple occasions that have now been documented with the court. Not only are they violating with their use of force and deployment of chemical agents, they are also not wearing clearly visible identification. In this notice filed, we can see the officers deploying tear gas but their faces are covered and there is no way to identify them. They are also supposed to be wearing body cameras. During an interview with the media, <strong>Bovino </strong>questioned the <strong>TRO </strong>and said he takes his orders from the executive branch, including <strong>President Donald Trump</strong> and <strong>DHS Secretary Kristi Noem</strong>. Federal judges really don't like it when you question their authority and flout their orders. Let's hope <strong>Judge Ellis</strong> throws the book at all of them!</span><br /><br /><span style="white-space:pre-wrap;">By 5PM, the <strong>9th Circuit Court of Appeals</strong> is also supposed to release their decision on the deployment of national guard troops to<strong> Portland, Oregon</strong>. The feds have lied to the court about the numbers of troops being deployed, so that may irritate the court. "</span><i><span style="white-space:pre-wrap;">Plaintiffs write to alert the Court of a material factual error by defendants on which the panel relied to grant a stay pending appeal. 	<description><![CDATA[<p><span style="white-space:pre-wrap;"><strong>ICE </strong>boosted spending on "small arms, ordnance, and ordnance accessories manufacturing" by <strong>700%</strong> over the last year. New spending in the small arms category totaled <strong>$71,515,762</strong>. Most of that money went toward guns and armor, but <strong>ICE </strong>also bought chemical weapons and "guided missile warheads and explosive components." 	<description><![CDATA[<p><strong>IMSI Catchers</strong> like <i>HailStorm </i>and Harris' <i>Stingray </i>violate the <strong>4th Amendment</strong>, so police want them to be a secret. They work by simulating a cell phone tower which then collects data on every cell phone within its range. Even if the police get a warrant for a particular target, these devices search every innocent person in the area. I've seen them deployed in surveillance vans, as well as <strong>DHS</strong> airplanes that circle above crime scenes and protests to collect data. The best defense is to not carry a cell phone, carry a burner phone, or put your phone in airplane mode when attending public events where you don't want to be tracked.</p><p><strong>TechCrunch </strong>has a good article showing the public records documenting the recent <strong>ICE </strong>purchase and explaining how the devices work.
